Neighbouring Tree Dispute – Tree Reports

A distressed client in a Melbourne’s Bayside suburbs contacted us because she thought a large neighbouring tree; a Cypress was damaging her home.
I prepared a tree report and recommended an engineer be engaged to inspect the house to confirm if the neighbouring tree was responsible for the house cracking. I believed this to be the case. The tree was approximately 6.5 meters away from the dwelling.
The engineers report stated:
“there is no doubt that the proximity of the tree in the neighbours property has caused the damage to the dwelling”.
“There was anecdotal evidence that tree roots from the neighbouring tree are invading the drainage system at this site causing blockages”.
“In our opinion consideration ought to be given to the placement of a root control barrier between the dwelling and the neighbouring tree to negate the drying effect of the tree but problems with this option are that the root barrier must be too close to the dwelling as this would cause an undermining of the footings (depending on the depth to which a barrier is founded)”.
In Victoria it is difficult to ascertain exactly what rights home owners or others have when attempting to protect their assets. An assumption is often made that local government does not wish to or cannot be involved in a dispute over a neighbouring tree.
My client decided to install root control barrier to a depth of approximately 1500 mm or more almost against her boundary adjacent to the tree. The trench was back filled with concrete.
The video provided shows there were surface roots between the concrete driveway strips and many roots just inside the property boundary adjacent to the tree. Some of the house brickwork was cracking and plaster was cracking inside the home.
The client was determined to protect her home and engaged a company to install the root control barrier.

Following the owner very happy with our consulting arborist service wrote a letter saying:
Each morning I walk along the driveway in amazement at the difference in my garden. Over the last 25 years I lost almost all the plants. Efforts to improve soil condition were wasted and new plants failed.
What a difference the root prune, synthetic and concrete barrier have made not only to that part of the garden but the entire property.
Now that the neighbouring tree is not sapping moisture from my property the cracks in the wall along the driveway have closed, the lawn strip and lawn have grown back and the Pomegranate tree situated 50 feet from the Cypress has an abundance of fruit compared to previous years.
It has been a long and expensive battle with the tree owner and council that should not have taken place but when I see the pleasures it gives others and myself I would go through it all again.
